Charge My Street –Terms & Conditions 

These Terms & Conditions ("Terms") set out the basis on which Charge My Street, a Community Benefit Society ("Charge My Street", "CMS", "we", "our", "us") provides access to and use of our electric vehicle (EV) charging services, including our chargepoints, website, mobile applications, and associated services (collectively, the "Services").

By registering with us, accessing our platform, or using a CMS chargepoint, you agree to be bound by these Terms.

 

1. Definitions

"Account" means your registered account with CMS.

"Charger / Chargepoint" means an EV charging unit owned, hosted, managed, or operated by CMS or our partners.

"Charging Session" means a period during which your EV is connected to and drawing power from a CMS chargepoint.

"Overstay Charge" means a fee applied when a vehicle remains connected to a charger after charging has completed or after the maximum permitted duration.

"Payment Method" means a valid credit or debit card, RFID card, subscription, or any other payment mechanism accepted by CMS.

"Tariff" means the price applied to the use of a chargepoint, as displayed in the app, website, or on-station signage.

"Event Outside Our Control" means any event beyond our reasonable control, including but not limited to power failures, grid interruptions, severe weather, vandalism, third-party telecommunications outages, and emergency safety issues.

 

2. Formation of Contract

A binding contract is formed between you and CMS when:

  • you register and accept these Terms via our website or app; or
  • you start a Charging Session using a CMS chargepoint, where registration is not required.

By entering a Charging Session, you confirm acceptance of these Terms.

 

3. Our Services

We will provide access to our network of chargepoints and related platform services from the date you accept these Terms.

We will use reasonable care and skill in providing the Services; however, uninterrupted availability cannot be guaranteed.

We may suspend or restrict access to a charger or service if:

  • the charger requires maintenance or has a technical fault;
  • you have failed to pay for a previous session;
  • we suspect fraudulent or unlawful activity; or
  • an Event Outside Our Control occurs.

 

4. Your Responsibilities

You agree to:

  • use CMS chargepoints safely and in accordance with instructions on-site or in the app;
  • ensure your EV and charging cable (if applicable) are safe and roadworthy;
  • move your vehicle once your charging session is complete to ensure fair access for others;
  • not tamper with or attempt unauthorised access to any CMS equipment.

CMS is not responsible for any damage caused by misuse of equipment or incompatible charging cables.

 

5. Tariffs and Charges

All Tariffs and fees for using CMS chargepoints are displayed in the app, website, or on the chargepoint itself. Fees may include:

  • energy usage charges (kWh-based);
  • any time-based charges;
  • connection or service fees; and
  • Overstay Charges where applicable.

Tariffs may vary between locations based on network, host site arrangements, and electricity supply costs.

Prices include VAT unless otherwise stated.

We may update Tariffs from time to time. Changes will apply to future Charging Sessions only.

 

6. Payment

To use CMS chargepoints, you must provide a valid Payment Method. You authorise us to:

  • verify your Payment Method via pre-authorisation (where applicable);
  • charge your Payment Method for Charging Sessions, including any Overstay Charges; and
  • charge any outstanding amounts owed to CMS.

If we cannot process a payment, we may suspend access to the Services until payment is resolved.

 

7. Overstay Charges

7.1 Billing Disputes

If you believe you have been incorrectly charged, you may dispute a charge by emailing hello@chargemystreet.co.uk. We will acknowledge and respond to all billing dispute enquiries within three working days.

Overstay Charges may apply where:

  • your EV remains connected after charging is complete; or
  • you exceed any posted maximum stay duration.

The applicable Overstay Charge will be displayed at the charger or in the app.

 

8. Reporting Faults

If you experience issues with a CMS chargepoint, you should report the fault via:

We do not guarantee resolution times and may not be the owner of the charger hardware; however, we will coordinate with partners to resolve issues as quickly as practicable.

 

9. Liability

Nothing in these Terms limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any statutory rights you hold as a consumer.

Subject to this, CMS is not liable for:

  • losses resulting from Events Outside Our Control;
  • loss of income, business, or opportunity;
  • damage to your EV except where caused by our negligence; or
  • indirect or consequential losses.

Where legally permitted, our total liability for all claims arising under these Terms is limited to £5,000 per user per year.

 

10. Events Outside Our Control

We are not responsible for delay or failure to provide Services caused by an Event Outside Our Control. If the interruption continues for more than 30 days, you may request cancellation of your account without penalty.

 

11. Data Protection

We will handle your personal data in accordance with our Privacy Policy, which explains how we process information such as:

  • identity details
  • contact information
  • payment information
  • charging behaviour and session history

We may use your data for billing, fraud prevention, troubleshooting, service optimisation, and regulatory compliance.

 

12. Changes to These Terms

We may update these Terms to reflect:

  • changes in law;
  • improvements to the Services;
  • changes to tariffs or payment processes;
  • operational or technological requirements.

Changes will be posted on our website, and continued use of the Services constitutes acceptance of updated Terms.

If a material change negatively affects you, you may close your account.

 

13. Transfer of Rights

We may transfer or subcontract our rights and obligations under these Terms to another organisation. We will notify you if this occurs.

You may not transfer your rights under these Terms without our consent.

 

14. Termination

You may close your account at any time by contacting us. All outstanding charges must be paid.

We may terminate your account if you breach these Terms, fraud is suspected, or payment issues persist.

 

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
